Understand the pathway before you act.

Eligibility, timing, evidence and risk should be assessed together before an application or response is prepared.

An open work permit is not tied to one named employer, but it is available only through specific programs or legal categories. Eligibility, timing, location and status requirements differ significantly between spousal, graduate, permanent-residence and other open-permit pathways.

“Open” describes the permit’s employer conditions; it does not mean that anyone may apply. Some open permits also contain occupation, medical, provincial or other restrictions.

Spousal open work permits

Eligibility through a spouse or common-law partner depends on the principal person’s immigration category and current circumstances. For international students, the program type and duration can be decisive. For temporary workers, the occupation, permit validity, permanent-residence pathway and current special instructions may matter.

The application should document the genuine relationship, the principal person’s valid status and qualifying activity, and the applicant’s own status and general eligibility. Rules in this area have changed repeatedly and should be checked immediately before filing.

Post-graduation work permits

A PGWP is a major planning priority because it is generally available only once and the eligibility record is built during the student’s program. The school and program must be PGWP-eligible. Program length, full-time enrolment, authorized leave, transfers, distance learning, completion date and study permit history can affect the result.

An eligible graduate normally applies within 180 days after confirmation of program completion. Current language requirements apply to most applicants, and a field-of-study requirement applies to some non-degree programs depending on when the study permit application was submitted. The official DLI and field lists should be checked at the relevant dates.

Work while the PGWP application is pending is not automatic. It depends on the applicant’s status and whether the current IRCC conditions for continued work were met when the application was submitted.

Bridging open work permits

A bridging open work permit can allow certain permanent-residence applicants to keep working while IRCC processes an eligible application. It is not available merely because a person has an Express Entry profile, provincial nomination or intention to apply. The permanent-residence category, submission and completeness stage, acknowledgement, current work status and permit expiry must be reviewed.

Other open-permit categories

Other categories may apply to sponsored spouses in Canada, some permanent residence applicants, refugees or protected persons, temporary resident permit holders and limited protective or public-policy situations.
